...OK, you have both possibilities now. One disadvantage of saving the spam is: if the admins/moderators do not check the spam regularly a "false positive" just disappears and the author can't do anything against it. If he gets an error message he can still modify the posting in order to be saved (e.g. remove suspicious links).
